Terms of Service – Alista Assistant

These Terms of Service (“Terms”) govern your use of the Alista Assistant mobile application (“App”), developed and operated by Valorein (“we”, “us”, “our”).
By installing or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 18 years old to use the App. By installing or using the App, you represent that you are at least 18 years of age.

The App is not intended for children or minors.

2. Description of the Service

Alista Assistant provides:

  • a conversational interface connected to the OpenAI API

  • optional voice interaction

  • device-level actions such as opening apps, creating calendar events, or performing assistant actions

  • home screen functionality

  • optional paid premium features

The App acts as a bridge between the user and third-party services (e.g., OpenAI, Google).
We do not generate AI responses ourselves and are not responsible for the content, accuracy, or safety of AI-generated output.

3. No Professional Advice

AI-generated responses may be incorrect, misleading, offensive, or unsafe.
The App and AI output must not be relied upon for:

  • medical advice

  • legal advice

  • financial advice

  • safety-critical decisions

  • emergency situations

All information is provided “as is” for general informational purposes only.

You agree that you use AI responses at your own risk.

4. User Responsibilities

You agree that:

  • You will use the App only for lawful purposes.

  • You will not attempt to misuse, reverse-engineer, or interfere with the App.

  • You will not use AI responses to cause harm, mislead others, or perform unlawful activities.

  • You are solely responsible for all actions you take based on the App’s output.

We are not responsible for any decisions, actions, or consequences resulting from your use of the App or interpretation of AI responses.

5. Device Actions and Automation

The App may perform certain actions on your device, such as:

  • creating calendar events

  • opening applications

  • reading device data explicitly granted by permissions

  • interacting with system-level assistant features

All actions:

  • occur only when initiated by you

  • run locally on your device

  • do not transmit your data to us

We disclaim all liability arising from device actions triggered by your use of the App.

6. AI Services (OpenAI)

When you use the assistant:

  • Your messages and conversational context are sent securely to the OpenAI API.

  • We do not transmit personal identifiers such as your name, email, or device ID.

  • OpenAI processes requests under its own Terms and Privacy Policy.

  • We do not control or guarantee AI accuracy, safety, or reliability.

You acknowledge that AI output may be incorrect or unpredictable.

7. Premium Features and Subscriptions

Premium access unlocks additional features, such as increased daily AI message limits.
Prices are determined by Google Play and may vary by region.

Subscription handling

  • Billing and renewals are managed entirely by Google Play.

  • You can modify or cancel your subscription at any time through your Google Account settings.

  • Refunds are handled according to Google Play refund policies.

  • Premium features remain available only while your subscription is active.

We do not store billing information and do not process payments ourselves.

8. Privacy

Your privacy is governed by our Privacy Policy, available at:

By using the App, you acknowledge that you have read and understood the Privacy Policy.

9. No Warranties

The App is provided “as is” and “as available.”

We make no warranties, express or implied, including:

  • accuracy

  • reliability

  • availability

  • suitability

  • fitness for a particular purpose

We do not guarantee that the App will be error-free, uninterrupted, or secure.

10. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for any damages arising from your use of the App, AI responses, device actions, or third-party services.

  • We are not liable for loss of data, loss of profits, or any indirect or consequential damages.

  • You agree that your sole remedy for dissatisfaction with the App is to stop using it.

11. Termination

We may suspend or terminate your access to the App if you violate these Terms or misuse the service.
You may stop using the App at any time by uninstalling it.

12. Governing Law

These Terms are governed by the laws of the Czech Republic, without regard to conflict of law principles.

Any disputes will be resolved exclusively in the courts of the Czech Republic.

13. Modifications

We may update these Terms from time to time.
Continued use of the App after changes constitutes acceptance of the updated Terms.
